Terms of Service

The agreement between you and card-exchange, covering the app and this website.

Plain-language summary: card-exchange is a meeting point for card collectors and vendors. We never handle money or cards, and we don't verify anyone. Every trade happens in person, at your own risk. Trade requires you to be an adult, and you can report or block anyone in the app.

This summary is an aid to reading, not a substitute for the terms below.

1. Who we are

card-exchange ("the Service", "we") is an app and website (card-exchange.ca) operated by the owner of card-exchange.ca, contactable at [email protected].

2. Acceptance and eligibility

These Terms govern all use of the Service. By creating an account or using the Service, you agree to these Terms. The Trade features additionally require explicit in-app acceptance, which is recorded against your account with a timestamp and version. If you do not complete that acceptance, you may use the card-identification and collection features, but not Trade.

You must be at least 13 years old to use the Service at all. You must have reached the age of majority in your province, territory, or state to use the Trade features. Trade involves meeting other users in person; it is not available to minors and must not be used by them. Account holders are responsible for use of the Service from their devices. You may hold only one account.

3. What the Service is — and is not

The Service helps collectors and vendors of trading cards find each other: it lists card shows, lets vendors publish cards they intend to sell at a show, and provides messaging attached to a proposed exchange.

The Service is a venue only. We are not a party to any transaction. We do not:

Event listings may be imported from public calendars and may be inaccurate, cancelled, or rescheduled without our knowledge; confirm details with the event organizer. Activity statistics, vendor codes, tenure indicators, and any badges shown in the Service reflect in-app activity only; they are informational and are not verification or endorsement of any user.

4. Transactions are at your own risk

Any exchange, purchase, or sale you conduct with another user happens directly between you and that user, in person, at a physical event we do not control. You assume all risk, including the risk of fraud, misrepresentation, counterfeit or damaged goods, non-payment, and personal safety. Prices shown in the Service are estimates, not valuations, and carry no warranty.

Safety guidance shown in the app (for example, meeting only at the stand a vendor has registered) is provided as-is and does not create any duty on our part. Stand and table numbers are self-reported by vendors and are not verified by us.

5. User conduct and content

You agree not to use the Service to defraud, harass, impersonate, or endanger anyone; not to misrepresent a stand or table assignment; not to solicit meetings outside event venues; and not to list goods you do not possess or may not lawfully sell.

In addition, you must not post or transmit content that: is illegal or promotes illegal activity; sexualizes, exploits, or endangers a minor (zero tolerance — such content is removed and reported to the relevant authorities); is sexually explicit; harasses, threatens, or promotes hatred or violence against any person or group; discloses another person's personal information without their consent; or is spam or deceptive.

You grant us a licence to store and display content you submit (listings, messages, photos) as needed to operate the Service, including retention after termination as needed for moderation, safety, and legal compliance. You represent that you own or have the rights to the content you submit. We may remove content, hide listings, restrict features, suspend, or terminate accounts at our discretion, with or without notice, including in response to user reports. We may review message content that is stored on our servers in response to reports. We are not obligated to monitor, and to the maximum extent permitted by law our moderation decisions create no liability to you.

6. Reports and blocking

The Service provides in-app tools to report and block other users. Reports may be reviewed and may result in content removal, listing hiding, or account bans. Filing a knowingly false report is a violation of these Terms.

7. Privacy

Our Privacy Policy (card-exchange.ca/privacy) explains what personal information we collect, how we use and disclose it, how long we keep it, and how to request access or deletion. Chat messages attached to an exchange are stored on our servers and may be reviewed in response to a report, as described in Section 5.

8. Intellectual property

You retain ownership of content you submit. If you believe content in the Service infringes your copyright, email [email protected] with: (1) identification of the work; (2) the location of the allegedly infringing material; (3) your contact information; (4) a statement of your good-faith belief that the use is unauthorized; and (5) a statement, under penalty of perjury where applicable, that the notice is accurate and that you are authorized to act for the rights holder. We will remove or disable access to infringing content in appropriate circumstances and will terminate the accounts of repeat infringers.

The Service, including its software, design, and databases, is owned by or licensed to us. Card names, images, and trademarks belong to their respective owners; the Service is not affiliated with, sponsored, or endorsed by any card publisher.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of pricing or event data, and non-infringement. Some jurisdictions do not allow certain warranty exclusions for consumers; where that is the case, the above applies to the maximum extent permitted, and nothing in these Terms limits rights that cannot lawfully be waived.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from transactions between users, event attendance, or reliance on any listing, price estimate, stand number, or user profile. Our total aggregate liability for any claim is limited to the greater of CAD $50 or the amount you paid us in subscription fees in the 12 months before the claim.

Nothing in these Terms limits or excludes our liability for our own fraud, gross negligence, or willful misconduct, for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited by applicable law.

11. Indemnification

To the extent permitted by applicable law, you will indemnify us against third-party claims arising from your breach of these Terms or your violation of law, except to the extent a claim is caused by our own negligence or misconduct.

12. Subscriptions

Paid subscriptions (card_exchange_pro) are billed through Google Play or the Apple App Store under their terms; those stores handle payment and refunds per their policies.

13. Termination

You may stop using the Service and request account deletion at any time by emailing [email protected] or via card-exchange.ca/delete-account. We may suspend or terminate accounts as described in Section 5. Sections 4, 5 (content licence and retention), 9, 10, 11, 15, 16, and 17 survive termination.

14. The Service may change

We may modify, suspend, or discontinue any part of the Service at any time, including features, event coverage, and data sources. We do not guarantee that the Service will be available, uninterrupted, or error-free, and we are not liable for unavailability caused by events beyond our reasonable control. If we permanently discontinue a feature you paid for, any refund for the unused portion of a subscription is handled by the app store through which you purchased it, under its policies.

15. App store terms

The app is distributed through the Apple App Store and Google Play. These Terms are between you and us only — not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing any claim relating to it, including product-liability, regulatory-compliance, consumer-protection, or intellectual-property claims. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing law and disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of British Columbia, except that either party may bring an individual claim in a small-claims court of competent jurisdiction, and nothing in this section deprives you of mandatory protections or forums available under the consumer-protection law of the place where you live.

17. General

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may assign these Terms in connection with a merger, acquisition, reorganization, incorporation, or sale of assets; you may not assign them. Our failure to enforce any provision is not a waiver of it.

18. Changes

We may update these Terms. Material changes will be presented in-app, and Trade features will require re-acceptance of the new version, which is recorded against your account.
